REFER A FRIEND TERMS AND CONDITIONS (“Terms”)

1. About the Scheme

Our Refer a Friend programme (“Scheme”) lets you share the love and get rewarded. It’s operated by Endura (“we”, “us”, “our”) and powered by Yotpo Ltd (“Yotpo”).

By taking part as either:

·         an existing customer who recommends us (a “Referrer”); or

·         a friend who has been referred (a “Referee”),

you agree to these Terms, our Privacy Policy and Yotpo’s Referral Terms (available at: https://www.yotpo.com/terms-of-service/) (together the “Applicable Terms”)

Participating in the Scheme is voluntary and subject to the Applicable Terms.

2. Who Can Take Part

·       Referrers and Referees must be 18 or over.

·       The Scheme is for individuals only (not businesses).

·       The Referee must be a first-time customer.

·       Employees of Endura (and their immediate family members) are not eligible to participate unless we state otherwise.

·       We reserve the right to verify eligibility and refuse participation at our discretion.

3. How it Works

·       A Referrer can share a unique referral link with a Referee.

·       The Referee can use the unique referral link to generate a referral code.

·       The Referee must use that referral code when making their first purchase.

·       The Referee must be a new customer (determined by us, acting reasonably).

·       If the Referee meets the offer requirements (such as minimum spend), the Referee will receive their reward.

·       Once the Referee’s purchase is completed and is not cancelled, the Referrer will become eligible for a reward.

·       If either the Referrer or a Referee returns a purchase, any refund will be limited to the amount actually paid. Any referral reward or discount applied will not be refunded or reinstated.  

We reserve the right to validate referrals and withhold rewards where the Scheme conditions have not been met.

4. Rewards

·       Reward details for Referrers and Referees (e.g. discount) will be set out in the relevant offer.

·       Rewards:

-       cannot be exchanged for cash;

-       are non-transferable; and

-       may be subject to additional conditions (e.g. minimum spend, product exclusions or expiry dates).

·       We reserve the right to substitute or vary rewards where reasonably necessary.

·       If a Referee’s order is cancelled, returned or refunded, we may cancel or withdraw any associated reward issued to the Referrer and/or Referee.

·       If a Reward exceeds the value of a purchase, any remaining balance will not be carried over unless expressly stated in the offer.

5. Fair Use

To keep the Scheme fair and enjoyable for everyone:

Referrers must:

·       only refer individuals they personally know;

·       not share referral links on coupon, deal, or cashback sites, public forums, or via spam; and

·       not create multiple or fake accounts or refer themselves.

We reserve the right to investigate suspected misuse at our discretion to:

·       withhold, cancel or reclaim rewards; and/or

·       suspend or remove a Referrer or Referee from the Scheme.

6. Limits

·       A Referrer may earn rewards for multiple successful referrals, subject to any limits specified in the offer.

·       We reserve the right to introduce or amend referral limits at any time.

·       A Referee may only redeem one referral reward.

7. Expiry

·       Any referral code (and any associated reward or credit) must be used within 12 months of issue, after which it will expire.

·       We reserve the right not to honour expired rewards.

8. Privacy
We use Yotpo to run the Scheme. This means personal data relating to Referrers and Referees may be processed so the Scheme can operate.  

By participating:

• Referrers confirm they have permission to share a Referee’s details where required.
• Referrers and Referees agree to the processing of their personal data in accordance with our Privacy Policy.

9. Changes to the Scheme
We may update, suspend or withdraw the Scheme (in whole or in part) at any time.

We also reserve the right to amend these Terms and/or the rewards offered provided that we will act reasonably in relation to rewards already validly earned.

10. Liability
The Scheme relies on third-party systems (including Yotpo). While we aim to ensure it runs smoothly, we do not guarantee uninterrupted or error-free operation.

To the extent permitted by law, we are not responsible for any loss arising from:

·       technical issues;

·       delayed or failed referrals; or

·       circumstances outside our reasonable control.

Nothing in these Terms limits or excludes any rights Referrers or Referees may have under applicable law.

11. General

·       Our decisions regarding the Scheme are final, acting reasonably.

·       These Terms are governed by the laws of England and Wales.
